The standard of care is a legal term, not a medical term. Basically, it refers to the degree of care a prudent and reasonable person would exercise under the circumstances. State legislatures, administrative agencies, and courts define the legal degree of care required, so the exact legal standard varies by state.
Varies by State: The specific legal definition of the standard of care can vary by state, as state legislatures and courts define the required degree of care. The vast majority of states follow the national standard, such as this from Connecticut Code §52-184c: "…that level of care, skill and treatment which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by reasonably prudent similar health care providers."
Breach of Duty: A breach of the standard of care means that the individual or professional failed to meet the expected level of care, potentially leading to negligence or malpractice claims.
Example – Medical Malpractice: In medical malpractice cases, the standard of care refers to the level of care a competent medical professional with similar training would provide under the same circumstances.
Beyond medical fields, the standard of care applies to lawyers, accountants, engineers, safety professionals, supervisors, and others in positions of responsibility.
Very few states use the locality standard today. Some apply "same or similar community" to generalists but the national standard for specialists. With telehealth and global access to information, the national standard is the safest benchmark.
